Tree removal in West Nyack: what is different here

West Nyack is the low, central part of Clarkstown where Route 59, Route 303 and the Palisades Center meet, with the Hackensack River and its wetlands running through the middle of the hamlet. Housing is a mix of 1950s and 60s capes and ranches near the river, larger 1970s and 80s colonials on the hills toward Strawtown Road and the Nyack line, and some older farmhouses with century-old shade trees.

The river shapes tree work here more than anything else. Low-lying West Nyack streets flood, and repeated flooding softens soil and rots roots, so big trees near the river and the wetlands are the ones that tip in storms. Several lots are partly in wetlands or within a few feet of a drainage channel, which matters for Clarkstown's permit rule. West Nyack is also home to one of only two trees the Town protects by name: the sycamore at Village Square.

Do you need a permit to remove a tree in West Nyack?

Private yard trees: West Nyack is an unincorporated hamlet of the Town of Clarkstown, so the Town's Tree Preservation law (Chapter 270, adopted 2013, most recently amended by Local Law 10 of 2026) applies to every owner, including owners of existing homes. You need a tree removal permit from the Department of Engineering and Facilities Management (DEFM) before removing more than one tree of 8 inches or more in diameter (DBH) per 5,000 sq ft of lot in any three calendar years, or any regulated tree in a state or federal wetland, within 25 feet of the top of a drainageway bank, on steep slopes, in the Town Historic District, or tied to new construction. On a typical quarter-acre (about 10,000 sq ft) lot that works out to roughly two big trees per three years without a permit; the next one needs it.

Exempt: dead trees (verified by DEFM or a certified arborist), trees posing an imminent danger to a structure, vehicle or pedestrians (you must give the Town documentary evidence within seven days of removal), DEC-listed invasive species, and trees on an approved tree preservation plan. Permitted trees are marked with red tape, not paint, and the permit is posted where it can be seen from the street. Taking a regulated tree without a permit means a fine of $500 to $1,500 per tree plus a replacement tree of at least 3-inch caliper (8 ft if evergreen). The application fee follows the Town's consolidated fee schedule.

West Nyack specifics: Clarkstown's code lists the sycamore at Village Square, West Nyack as a protected tree (§ 270-7). More practically, lots along the Hackensack River and its tributaries often fall under the wetland or 25-foot drainageway trigger, so a riverside tree can need a permit even if it is the only one you are taking down this year.

Rockland County license: tree removal is a "home improvement" under Chapter 286 of the Rockland County Code, so any business paid to take down trees at a home in Rockland must hold a Rockland County home improvement contractor license, which requires insurance. You can check a license on the county's Licensed Businesses dashboard (rocklandcountyny.gov) or with Consumer Protection at (845) 364-3901. West Nyack questions

Do I need a permit to remove a tree in West Nyack?

West Nyack follows Clarkstown's Chapter 270: no permit for one tree of 8 inches or more per 5,000 sq ft of lot every three calendar years, but a DEFM permit for more than that or for any regulated tree in a wetland, within 25 feet of a drainageway, or on a steep slope. Dead and imminently dangerous trees are exempt with documentation.

My yard floods. Should I worry about my big trees?

Repeated flooding damages roots, so it is worth having large trees near the house checked, especially if they lean, have fungus at the base, or have cracked soil on one side. See our hazardous tree assessment guide.

How much does tree removal cost in West Nyack?

Published 2026 New York ranges: about $300 to $600 for a small tree, $600 to $1,200 for a medium tree, $1,200 to $2,200 for a large tree, and $2,000 to $3,500 or more for a crane removal over a house, plus $100 to $400 per stump.

Can I remove the tree in the strip between the sidewalk and street?

Not without asking. Trees in a road right-of-way belong to the road's owner: the Town of Clarkstown for town roads, Rockland County or New York State for Routes 59, 303 and other county and state roads.
